ADDITIONAL SHIPPING AND DELIVERY TERMS

    The delivery dates stated in Quotations or Order Confirmations are only approximate and not conditions of the Sales Contract. Whilst every reasonable effort will be made to keep the given delivery dates, King Newton shall be under no liability whatsoever if delivery is delayed for any reason beyond King Newton’s immediate control. In particular King Newton does not accept liability for any direct or indirect loss arising from delayed delivery in those circumstances.

    The estimate of the delivery date is generated under the premise of all necessary transaction information is fully provided and the payment is completed.
   

    If the buyer is unwilling or unable to accept delivery at the premises stated on the Purchase Order (or in the case of an Export Sale to accept the shipping documentation), resulting direct or indirect loss for King Newton include but no limited to additional freight, handling charge, loading fee, stocking cost or tax, etc., King Newton has the right to claim all related loss, and to charge for the remaining product for storage fee.  
   

    Seven days after the buyer fails to accept the delivery of the goods (or sign the receipt), King Newton has the right (but no obligation) to sell the goods to a third party without refunding the price paid by the buyer for the particular order; The resale proceeds belongs to King Newton and King Newton only.
   

    In no circumstances will the buyer be entitled to reject the goods on the grounds of shortage.
